Welcome to YoUShop. The terms “we,” “us” and “our” refer to YoUShop. YoUShop operates this store and website, including all related information, content, features, tools, products and services, to provide customers with a curated shopping experience (the “Services”). YoUShop is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when using the Services.

Returns and exchanges are governed by our Return and Refund Policy.

Prices, discounts and promotions may change without notice. The price charged will be the price displayed when the order is placed and shown in the order confirmation.

The YoUShop name, logo, product names, designs and slogans are trademarks of YoUShop or its licensors. Shopify’s name, logo, product names, designs and slogans are trademarks of Shopify. Other names and trademarks belong to their respective owners.

Section 7 – Optional tools

We may provide access to tools operated by third parties that we do not monitor or control.

Access to these tools is provided “as is” and “as available,” without warranties, representations, conditions or endorsements. To the extent permitted by law, we are not responsible for loss resulting from your use of optional third-party tools.

YoUShop is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are made directly from YoUShop.

By using the Services, you acknowledge that Shopify is not the seller of products offered by YoUShop and is not responsible for transactions between you and YoUShop, including injury, damage or loss caused by purchased products or services, except where applicable law provides otherwise.

Section 10 – Privacy

Personal information collected through the Services is handled according to our Privacy Policy. Certain information may also be processed according to the Shopify Consumer Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes information concerning your access to and use of the Services to operate and improve them. • You have disclosed compensation or incentives received in connection with it.
• Your Feedback complies with these Terms and applicable law.

We are not required to keep Feedback confidential, compensate you for it or respond to it.

We may monitor, edit or remove Feedback that we reasonably believe is unlawful, offensive, defamatory, obscene, infringes another person’s rights or otherwise violates these Terms.

You must not submit Feedback that violates intellectual-property, privacy or other rights; contains malicious software; uses a false identity; or misrepresents its origin. You are responsible for the content and accuracy of your Feedback.

The Services may occasionally contain typographical errors, inaccuracies or omissions involving product descriptions, pricing, promotions, shipping charges, delivery estimates or availability.

Subject to applicable law, we may correct errors, update information or cancel affected orders when information is materially inaccurate. If an accepted order is cancelled, any payment collected for that order will be refunded using the original payment method.

We may use technical measures to restrict whether and how Agents access the Services.

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services or when otherwise permitted by law. You remain responsible for amounts properly due before termination.

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, severability, governing law and privacy.

To the extent permitted by law, you agree to indemnify and hold harmless YoUShop, Shopify and their affiliates, partners, officers, employees, agents, contractors, licensors and service providers from third-party claims arising from:

• Your violation of applicable law
• Your infringement of a third party’s rights
• Your unlawful misuse of the Services

We will provide reasonable notice of an indemnifiable claim. You agree to provide reasonable cooperation in its defence.

Section 19 – Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in effect.

Section 20 – Waiver and entire agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies referenced herein constitute the entire agreement between you and YoUShop concerning your use of the Services and supersede previous agreements or communications concerning the same subject.

Section 21 – Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations as part of a legitimate business transfer, restructuring or similar transaction, subject to applicable law.

Section 22 – Governing law

These Terms and any separate agreements through which we provide the Services are governed by the laws applicable in Telangana, India, without limiting any mandatory consumer rights available under the laws of the customer’s place of residence.

Courts with appropriate jurisdiction in Telangana, India, will have jurisdiction over disputes, except where applicable consumer law provides otherwise.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.
